The court of the administrative litigation of Murcia No. 5 dismisses in its entirety the demand of the Casa Pintada Foundation for which it claimed to the City Council € 1,066,404.97 plus legal interest.
Said Foundation also requested in its application the transfer of the Convent of San Francisco as well as the payment, by the City of Mula, of the procedural costs.
The ruling indicates that it is curious that there is no claim of the amounts that were considered due until 2018, when the period of 10 years originally planned had expired and the City Council had initiated and resolved a refund file claiming to the Foundation the return of the amounts paid for lack of justification of its destination.
To this it adds the sentence that the Foundation neither communicated the annual budgets of the Foundation nor the expenses of operation that allowed to specify the amounts to pay by the City council, reason why it rejects the request.
As for the convent of San Francisco, the judgment indicates that said assignment was at the expense of a new agreement that never was signed, indicating that this meant a mere declaration of intent by both parties.
The judgment dismisses, consequently, in its entirety all the claims deducted by the Casa Pintada Foundation, declaring conformity to the law of municipal action.
The mayor, Juan Jesús Moreno, has indicated that the only thing that moves us in this matter is the defense of the general interest of citizens and the economic safeguard of public resources.
In addition, we are already studying the next steps to take about the presence of the Foundation in the municipality and the denomination of some public spaces.
